In a big relief to NPS Group of Schools, the Karnataka High Court has quashed the FIR lodged against the school and also the order of withdrawal of affiliation by the CBSE about a month later in relation to fake minority certificate controversy.
Allowing the petitions filed by Dr K P Gopalakrishna, chairman of NPS Institutions and others, Justice Anand Byrareddy has noted that when the question as to whether the petitioner could claim linguistic minority is in balance in the absence of a notification and pending litigation, the entire question as to whether the petitioner had derived any benefit on account of alleged forgery even if fastened on the petitioner is doubtful.
The petitioners had contended that the allegations made against them in the complaint do not constitute any alleged offences (cheating) as they have not derived any benefits out of the said ‘fake ‘ minority certificate. They further claimed that the action of the authorities affected nearly 10,000 students studying in their schools. -KK, NGB
