Former MP R Dhruvanarayan for relook at SC verdict on reservation

Mysuru, February 13:- Former Member of Parliament from Chamarajanagar R Dhruvanarayan has urged the central government to reconsider the interpretation of the Supreme Court ruling on reservation for Scheduled Castes, Scheduled Tribes and Backward Classes.

“The Supreme Court passed a judgment in a civil appeal case in the state of Uttarakhand on 7-2-2020. The Uttarakhand High Court had issued a judgment on the reservation the Uttarakhand State government had to provide to the Scheduled Caste and Scheduled Tribes. The Supreme Court issued a judgment in the civil appeal suit on the same issue. It stated that it is left to the discretion of the states to decide on the prominence to Scheduled Caste and Scheduled Tribes in government jobs. The judgment said that reservation as not a fundamental right. This is a very dangerous interpretation. This is unconstitutional.  And is against the Backward Classes,” he said at a press meet held at Congress office on JLB Road in the city, on Thursday.

“The third chapter of the Constitution is on the fundamental rights coming under Article 12 to Article 35. Article 16 (4) provides reservation of direct appointment of Scheduled Castes and Scheduled Tribes and Article 16 (4A) provides reservation in promotion for Scheduled Castes and Scheduled Tribes. It is thus a fundamental right granted under Articles 16 (4) and 16 (4A). Demanding proper representation based on the population of the state is the fundamental right of the Scheduled Castes, Scheduled Tribes and Backward Classes. But the judgment is not reasonable,” he said.

“The reason for this is that the Bharatiya Janata Party is against the reservation policy. The BJP government in Uttarakhand has argued in the Supreme Court that reservation is not a fundamental right. It is unfortunate that the Supreme Court ruled that. RSS coordinator Mohan Bhagwat and press secretary Manmohan Vaidya have made several statements against reservation. This mindset of RSS is anti-semitic,” he added.

“The Sangh Parivar and BJP are against social justice. They demolished the temple of Saint Ravidasa in Delhi. They have weakened the Violence on Scheduled Caste and Scheduled Tribe Prevention Act. The Violence Prevention Act has been strengthened after the Congress argued in Parliament. The scholarship of students belonging to SC/ST has not been revised since 2014. The entire BJP-led central government is anti-Dalit,” he accused.

He said, “With the BJP in power at the Centre, there are suspicions that most government agencies are working on the lines of the Hindutva agenda and other secret agendas. The judiciary is no exception.” He added that the dark shadow of Hindutva on the judiciary is becoming clear.

The BJP and its allies in power at the Centre must request the Supreme Court to reconsider its verdict to prove they are pro-Constitution.
